What is an occurrence vs claims based policy?

An occurrence based policy is a type of cover which will pay out in the event of a historical claim event after the policy has expired. This type of cover is very common in certain professions such as medicine.

For example, if a medical practitioner had an occurrence based policy in place from 1980-2000 and a claim for loss or damage that took place in 1998 is made in 2005 ,then the practitioner would still be covered by the policy even though the policy ended in 2000 i.e the practitioner stopped paying the premium in the year 2000.

A claims based policy will only cover the insured during the policy and does not include cover for after the policy has expired. 

A claims based policy works on when the claim is filed rather than when the alleged negligence occurred.

The occurrence based policy provides more expensive cover but is generally more expensive.

You are not legally required to have professional indemnity insurance to continue trading but if you provide advice, services or handle sensitive data on behalf of clients you are potentially liable to a claim for loss due to errors and would benefit from having a professional indemnity policy in place.

This is only partially true. You are still potentially liable for claims which arise if you have a separate private practice or network. Your public contract – the Clinical Indemnity Scheme – also does not cover you for everything so if you are subject to libel or defamation due to public comments you made.

Each policy is unique but the majority of policies cover most – if not all – of the legal fees arising out of a claim of negligence against you. If there are penalties imposed as a result of a claim being found against you this is not necessarily covered unless specified in your policy.

For example a claim was made against a marketing firm for failing to print the correct telephone number for the client on promotional material produced as part of the commercial arrangement.

Public liability insurance and professional indemnity insurance insure against different scenarios. Public Liability normally covers against loss or injury to 3rd parties from slips or falls. Professional indemnity covers you for the financial loss to a client due to mistakes made during the course of business. Public liability won’t cover you for the areas commonly covered such a breach of contract, copyright, libel etc and professional indemnity insurance won’t protect you against someone who slips and injures themselves at your place of business.
